GENERAL TERMS AND CONDITIONS OF SALE
The following Terms and Conditions will apply to all agreements organized by Asia Travel and Estate Co. Ltd.
SUPPLIER (Asia Travel and Estate Co., Ltd.)
OPERATOR (Agent-Tour Operator-User)
Prices, Validity, Inclusions, Exclusions. Our rates are exclusively quoted net to the Operator, in Thai Baht. Quotations in other currencies are subject to the real exchange rate provided at the time of quotation and subject to confirmation at the time of balance payment with an increase or decrease compared to the local currency. Payments are only accepted in the local currency. The rates include 7% VAT and 10% service charge. (For some destinations, there may be additional costs that will be indicated at the time of booking.) The validity dates are specified for each service.
Rates are subject to change without notice due to currency exchange, fuel costs, tax variations, etc. Please check the rates for any last-minute updates or promotions or request confirmation by sending an email to rsv@asiatravelestate.com.
BOOKING
All bookings must be made by sending a written request via email to the address: rsv@asiatravelestate.com or alternatively, they can also be made online, after logging in with the User and Password provided during the registration on www.asiatravelestate.com. All booking requests must contain the necessary information to proceed with the reservation, such as the client's full name, hotel, number of people, dates, and other relevant details. Bookings will be confirmed only after receiving written confirmation from Asia Travel and Estate Co. Ltd.
For bookings exceeding 4 pax or for certain types of bookings, Asia Travel and Estate Co. Ltd may require a deposit for the confirmation of the reservation. The amount of the deposit will be communicated at the time of booking, and the booking confirmation will be made only after receiving the due amount.
Payments
Payments, including deposits and balances, must be made within the time limits indicated in the statement of each booking, sent with each booking confirmation. The balance of any Last-Minute reservations must be paid within 24 hours of the booking confirmation and receipt of the statement by credit card (additional costs of 5% for Card Payment with PayPal and 3% for Money Space). Otherwise, the bookings will be automatically canceled and subject to reconfirmation. Payments must be made to our bank accounts, indicated in the statement sent with the booking confirmation. We accept payment by bank transfer with the clause "Each pays its own." In the case of charges from intermediary banks, these are borne by the Operator. Asia Travel and Estate Co. Ltd is only responsible for collection fees withheld by its own bank (approximately 200 BAHT). Operators are advised to check with their bank when intermediary bank charges occur. Asia Travel and Estate Co. Ltd. assumes no responsibility for service disruptions or cancellations by suppliers due to non-receipt of payments within the specified terms.
Cancellations
FIT Individual or GIT bookings:
For bookings with Standard Departure Programs: In the event that customers need to cancel the reservation, this must be done in writing by sending an email to rsv@asiatravelestate.com, and it is considered canceled only and exclusively upon receipt of our confirmation. Please note that it is the operator's responsibility to request the sending of the confirmation.
PENALTIES FOR CANCELLATION OF PROGRAMS WITH STANDARD DEPARTURES: EXCEPT FOR PERIODS 20 Dec - 15 Jan and 1-31 August
- Cancellation up to 31 days before arrival: 2,500 THB/PAX
- Cancellation from 30 to 15 days before arrival: 30% of the Package cost
- Cancellation from 14 to 7 days before arrival: 50% of the Package cost
- Cancellation from 7 to 1 day before arrival and/or NO Show: 100% of the Package cost
FOR PERIODS 20 Dec - 15 Jan and 1-31 August:
- Cancellation up to 45 days before arrival: 2,500 THB/PAX
- Cancellation from 44 to 30 days before arrival: 30% of the Package cost
- Cancellation from 29 to 15 days before arrival: 50% of the Package cost
- Cancellation from 14 to 1 day before arrival and/or NO Show: 100% of the Package cost
Additional fees by the hotel may apply for Non-Refundable bookings or different cancellation rules, which will be communicated to us by the hotel.
For group bookings: The cancellation penalty will be communicated at the time of quotation.
Sales conditions
All offers are valid for 10 days from the date of issue. After this period, the offers must be quoted again. To confirm the reservation after receiving our availability confirmation, a deposit equal to 30% of the total amount must be paid (excluding national and international flights, insurance, visas, and extra documents, which must be paid in full before their issuance). If no communication is received within 24 hours regarding the payment of the 30% deposit and 100% of flights/visas/extra documents, the reservation will be automatically canceled, and a new booking will be necessary without guaranteeing the same availability and rates. If a deposit is required by any supplier, the payment of that deposit must be forwarded to us upon our request. If the reservation is made 31 days or less before arrival, the full payment is required. The full payment must be received by Asia Travel and Estate Co. Ltd. within 30 days before the client's arrival. Our quotations are in Thai Baht or other Southeast Asian currency; in case of exchange rate variations exceeding 3% at the time of the deposit payment and subsequently the balance, Asia Travel and Estate reserves the right to request this difference from the customer.
National and international flights: The costs and availability of international and/or national flights may vary within a few hours and days. The client assumes the risk of any changes that may occur between our travel quote and its acceptance. Therefore, at the time of the request, the customer will be informed of any changes and asked whether they wish to proceed with the issuance or cancel the flight.
Facilities and/or services availability: During high-season periods when there are no hotels included in the Asia Travel and Estate program, replacements may be made for all or part of the hotels with others of the same category or higher.
MODIFICATIONS OF BOOKINGS
Any modifications to already confirmed bookings must be communicated in writing to the following address: rsv@asiatravelestate.com. Asia Travel and Estate Co. Ltd will do its best to accommodate modification requests, but cannot guarantee availability. Modifications to bookings may incur additional costs, borne by the customer.
PRICES AND SERVICES
The prices indicated are valid for the specified period and refer to the services included in the booking. Prices are expressed in the local currency and are subject to changes in case of fluctuations in currency exchange rates. Prices may also be subject to changes in case of alterations in the costs of services or government taxes. Asia Travel and Estate Co. Ltd reserves the right to adjust prices in the event of such variations.
SERVICES AND RESPONSIBILITIES
Asia Travel and Estate Co. Ltd undertakes to provide the services as described in the booking and ensure a satisfactory level; the levels of facilities and other services are based on various variable factors, generally accepted as indicative for certain categories. However, we do not represent or warrant the standard, class, or attributes of accommodations, lodgings, or services. Hotel classifications are based on local standards, typically established by competent Tourism Authorities. Asia Travel and Estate Co. Ltd acts as an intermediary between the agent and transportation companies, hotels, and all other service providers. Therefore, Asia Travel and Estate Co. Ltd cannot be held responsible for any loss, damage, accident, program changes, or any other irregularity arising from circumstances beyond the company's control, both within and outside the programs, including but not limited to wars, civil unrest, fires, floods, exceptional weather conditions, acts of God, acts of governments or other authorities, accidents, or machinery, transportation, and equipment breakdowns, or industrial actions. Asia Travel and Estate Co. Ltd reserves the right to modify itineraries and change services with or without notice if such situations are beyond the Company's control or if unforeseen circumstances require actions for the benefit of all parties involved. No refund is provided in case of program cancellation due to circumstances beyond the control of Asia Travel and Estate Co. Ltd.
COMPLAINTS
In case of a complaint, it should preferably be filed on-site with the assigned assistant so that Asia Travel and Estate Co. Ltd can work best to resolve the situation that generated the complaint. In any case, the complaint must be submitted in writing within 8 days from the date of the conclusion of the services. Asia Travel and Estate Co. Ltd will do its best to resolve the matter amicably with mutual understanding. If this is not the definitive solution, local arbitration in Thailand, specifically in the city of Bangkok, will be pursued to resolve any disputes or claims.
Insurance
Asia Travel and Estate Co., ltd. provides insurance exclusively for accidents that occur during our tours and excursions (ONLY IN THAILAND DESTINATION), up to a maximum of 500,000 THB per person, or 1,000,000 THB in case of death/disability, with a total maximum of 50,000,000 THB for all events. No insurance is provided for other Asian destinations. It is mandatory according to the new regulations in force in the Kingdom of Thailand (WE RECOMMEND TO HAVE ONE ANYWAY FOR EACH ASIAN DESTINATION) for each passenger to have their own personal travel insurance to be able to cover unforeseen medical expenses, hospitalizations, evacuations, emergency repatriations, personal injuries, accidents, cancellation penalties, loss or damage of luggage, and any other unexpected events that may occur during the travel period. Failure to do so may result in denial of entry into the kingdom during airport checks. Additionally, it is advised to check for any prohibitions, including unauthorized medications without the corresponding official medical documentation. With reference to the Kingdom of Thailand, we remind you of the restrictive laws concerning the use and possession of narcotics, which may lead to arrest and heavy fines. Furthermore, the possession and use of electronic cigarettes are prohibited, which could lead to 3 years of imprisonment and a fine of 200,000 baht. In all these cases, ASIA TRAVEL AND ESTATE CO., LTD. CANNOT BE HELD LIABLE IN ANY WAY.
GENERAL IMPORTANT WARNINGS (REFERRED TO THE THAILAND SECTOR; FOR OTHER DESTINATIONS, REFER TO THE TRAVEL DOCUMENTS RELATING TO EACH OF THEM)
ARRIVAL:
INTERNATIONAL FLIGHTS
Suvarnabhumi Airport: After completing the relevant formalities with the immigration and retrieving the luggage, customers must exit at "EXIT B," turn right, and continue until reaching Exit Gate No. 3, where our assistant will be waiting. In case of difficulties, they can call our Hotline service or use our APP chat. The maximum waiting time for the assistant is set at 90 MINUTES from the time of landing. After this time, it will be considered a NO SHOW, and customers must reach their hotel at their expense, either by taxi or by requesting a new transfer through us, and they will have to pay the new vehicle directly to our assistant on-site. It is strictly forbidden to leave the airport on your own without our authorization, and no refund will be provided if this occurs.
Don Muang Airport: After completing the relevant formalities with immigration, customers must take the escalator down to retrieve their luggage, and then they can exit outside where they will notice a metal ring where our assistant will be waiting. The maximum waiting time for the assistant is set at 90 MINUTES from the time of landing. After this time, it will be considered a NO SHOW, and customers must reach their hotel at their expense, either by taxi or by requesting a new transfer through us, and they will have to pay the new vehicle directly to our assistant on-site. In case of difficulties, they can call our Hotline service or use our APP chat. It is strictly forbidden to leave the airport on your own without our authorization, and no refund will be provided if this occurs.
Domestic Flights
Suvarnabhumi Airport: Customers must exit at "EXIT," turn left, and continue until reaching Exit Gate No. 3, where our assistant will be waiting. In case of difficulties, they can call our Hotline service or use our APP chat. It is strictly forbidden to leave the airport on your own without our authorization, and no refund will be provided if this occurs.
Don Muang Airport:
After retrieving their luggage, customers can exit outside, where they will notice a metal ring where our assistant will be
waiting. In case of difficulties, they can call our Hotline service or use our APP chat. It is strictly forbidden to leave the
airport on your own without our authorization, and no refund will be provided if this occurs.
The maximum waiting time for the assistant is set at 90 MINUTES from the time of landing. After this time, it will be
considered a NO SHOW, and customers must reach their hotel at their expense, either by taxi or by requesting a new transfer
through us, and they will have to pay the new vehicle directly to our assistant on-site. If the customer departs from the
airport independently without our authorization, no refund will be provided.
TRANSFER SUPPLEMENT: For hotels located in Thonburi (opposite side of the river, such as Hilton Millennium, Ibis Riverside, Anantara Riverside, etc.), a supplement of 300 THB/Pax is required.
HOTELS OUTSIDE OUR CIRCUIT(SO BANGKOK, RAMADA RIVERSIDE CENTURY PARK, VIC3): If customers are staying at a hotel outside our pick-up circuit (SO BANGKOK, RAMADA RIVERSIDE CENTURY PARK, VIC3), our assistant will not meet them at such hotels. In the case of hotels not booked through us, customers must reach the designated meeting point, which is set at Century Park. Customers should be in the lobby between 06:45 and 07:00. If the hotel is booked through us but is located outside our circuit (SO BANGKOK, RAMADA RIVERSIDE CENTURY PARK, VIC3), customers must reach one of the aforementioned hotels closest to them.
PICK UP: For Join (collective) Excursions and Tours, NO PICK UP is possible for hotels located in Thonburi (opposite side of the river, such as Hilton Millennium, Ibis Riverside, Anantara Riverside, etc., and hotels that are outside our circuit). Customers will have to reach the meeting point at their own expense. On request, private transfers can be organized with a supplement.
PICK UP 2: For Tour Around, if the hotel in Bangkok is not booked with us, customers must reach the meeting point, which is set at Century Park. Customers should be in the lobby between 06:15 – 06:30. If the hotel is booked through us but remains outside the pick-up circuit (So Bangkok,Ramada Riverside, Century Park, Vic3), customers must reach one of the pick-up hotels closest to them.
DATE AND TIME CHANGES: Join (Collective) Excursions are confirmed with indicative dates and times, and these may change in the day and time of operation due to local organizational needs. Customers will receive the updated program both during the meeting with the assistant and directly on our APP. Please inform customers at the time of booking about the possibility of changes in dates and times and that if customers do not show up (perhaps because they have booked other services on their own), it will be considered a no-show, and no refund will be provided.
VISIT VARIATIONS: All excursions and packages may undergo variations, changes in the program, changes or removal of stops even at the last moment, due to force majeure (reasons that would jeopardize the continuation, cause damage, technical reasons, or timing). No refund is due to customers when this occurs due to reasons not attributable to the Operator.
NUMBER OF PASSENGERS:
Asia Travel and Estate has always been committed to providing quality service, and for this reason,
we always try to maintain a limit of 8 passengers plus the guide, excluding the months of July, August, and December, and
National and International holidays, where departures may have a larger number of passengers and/or the use of buses with
higher capacity. For those who need personalized service, we recommend requesting services on a private basis; in that case,
we can confirm only after receiving confirmation of the guide's availability and with the corresponding supplement, as we are
forced to request Freelance Guides (in case of cancellation, no guide fee refund will be provided). (REFERRED ONLY TO THE
THAILAND SECTOR)
During the month of August, in case of unavailability of a guide in Italian, an English-speaking guide will be assigned (this
information pertains to every destination served by us).
FLIGHTS: Operators are required to provide all flight data at the time of booking services. The data must include the airline, flight code, departure time, and departure airport, as well as the arrival time and airport. Any subsequent changes must be immediately communicated to rsv@asiatravelestate.com, and make sure to have a receipt confirmation within the next 24 hours. No responsibility can be attributed to Asia Travel and Estate in case of non-communication or incorrect communication.
TOURIST GUIDES: All guides used by us have the regular license issued by the TAT (Tourism Authority of Thailand) or an Official Guide License for other destinations, and they all have several years of experience. However, it is always useful to inform customers that they are self-taught; after a basic course, they have refined their language skills by accompanying Italian customers on excursions and tours. Their knowledge of the language is therefore sufficient but certainly not of a high level. In certain periods of the year, due to a shortage of Italian-speaking guides, we may use English-speaking guides, with or without an Italian-speaking assistant.
CANCELLATION OF CONFIRMED BOOKING:
Asia Travel and Estate may cancel confirmed bookings when technical reasons arise that prevent the regular execution of the
program or cause damages.
Receipt of payment, even if a booking has been confirmed, does not guarantee the provision of the service in case a booking
has been rejected. In the event of a payment made without submitting the booking request, Asia Travel and Estate Co. Ltd
reserves the right to refuse payment confirmation and subsequently cancel the services. If a customer cancels an excursion
after another service has been confirmed, the fee will not be refunded. In case of non-participation in an excursion for any
reason, a penalty of 100% of the total cost of the excursion will be charged.
LIABILITY: Asia Travel and Estate assumes no responsibility for accidents, injuries, damages to persons or property, delays, loss of time, or any other inconvenience. Neither the agency nor its agents and suppliers can be held responsible for any additional costs due to delays, program changes, train or flight disruptions, adverse weather conditions, or other events beyond the agency's control. The agency assumes no responsibility for theft or damage to personal belongings or for any injury during the excursion or tour. The excursions are guided, and the guide has the right to interrupt the excursion if a customer is deemed unfit to continue the excursion for health reasons or inappropriate behavior. In such cases, the customer is not entitled to a refund.
CHANGES: Asia Travel and Estate Co. Ltd reserves the right to cancel, modify, update, or add to the general conditions at any time and without notice. The updated general conditions will be published on our website. If a customer books a service without requesting the new general conditions, they will still be bound by the general conditions published on the website at the time of booking.
Receiving the booking confirmation from Asia Travel and Estate Co. Ltd means that the above-mentioned conditions and responsibilities have been accepted by the Operator.
